1.1 The EU General Data Protection Regulation, the Data Protection Act 2000 and the Data Protection Amendment Act 2018 serve the right to protection of personal data. We process your data exclusively on the basis of the statutory provisions (GDPR, DSG 2018, TKG 2003).

3. Data categories, purpose and lawfulness

3.1 We do not process any sensitive („special“) data categories of our customers and business partners. Sensitive („special“) categories of data that we do NOT process include data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. Of course, we also do not process any data on criminal convictions and offenses committed by our customers and users.

3.2 We require the collected personal data for the fulfillment of the contract, billing, assertion of contractual claims, for customer service purposes and for advertising purposes. The data is collected, stored, processed and used for this purpose.

3.3 The legal basis for the processing of your personal data is, on the one hand, contract performance, legitimate interests, the fulfillment of our legal or contractual obligations and, on the other hand, your consent (e.g. declarations of consent, contact form, cookies). Failure to provide the data may have various consequences.

3.4 Data collection when visiting the website: In principle, the website can be visited without providing any personal information about the user. In this case, we only store access data without personal reference, such as the name of the Internet service provider, the page from which the user visits the websites, the IP address (anonymized) or the date and time of the visit. This data is only evaluated anonymously to improve the offer and does not allow any conclusions to be drawn about the person of the user.

3.5 We check links that leave our website very carefully from an editorial point of view. Nevertheless, we accept no responsibility or liability for the content of pages linked to from this website or from another website.

4. Contact form / declaration of consent

4.1 Your details, including personal data from our contact form on www.fmw.co.at, will be transmitted to us via our own mail server, processed and stored by us in order to process your request. This data will not be collected or passed on without your consent. We cannot process your inquiries without this data.

4.2 Data processing is carried out on the basis of the legal provisions of § 96 para. 3 TKG and Art 6 para. 1 lit a (consent) DSGVO.

5 Storage period

5.1 We process your personal data, if necessary, for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) as well as beyond that in accordance with the statutory storage and documentation obligations arising from the Austrian Commercial Code (UGB), the Federal Fiscal Code (BAO) and until the end of any legal dispute, ongoing warranty and guarantee periods, etc.

6 Rights of data subjects

6.1 If your consent is required for the processing of your data, we will only process it with your express consent.

6.2 In principle, we do not process data of minors and are not authorized to do so. By giving your consent, you confirm that you have reached the age of 14 or that you have the consent of your legal representative.
6.3 Right to information: Upon request, we will provide you with information free of charge about the scope, origin and recipient(s) of the stored data as well as the purpose of the storage. In the event of excessive requests for information (more than 4 times per year), we reserve the right to charge a fee.

6.4 Right to rectification: Should incorrect or incomplete information be stored despite our efforts to ensure that the data is correct and up to date, we will rectify it at your request.

6.5 Erasure: Under certain circumstances, you have the right to erasure, for example in connection with an objection or if data has been collected unlawfully. If the legal requirements for erasure are met (i.e. there are no legal obligations or overriding interests to the contrary), we will carry out the requested erasure immediately.

6.6 Restriction: You can also request the restriction of data processing for the reasons that justify a claim for erasure – in this case, the stored data must remain stored (e.g. for evidence purposes), but may no longer be used for other purposes.

6.7 Objection/revocation: You can object to data processing that we carry out on the basis of a legitimate interest – as far as data processing for direct marketing purposes is concerned, this right of objection is absolute. Consents given can be revoked at any time in writing and free of charge.

6.8 Data portability: If you wish to transfer the data you have provided to another controller, we will provide it in an electronically transferable format.

6.9 Right to lodge a complaint with the data protection authority: We would also like to draw your attention to your right to lodge a complaint with the data protection authority: you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes this Regulation. 8 Data security

8.1 FMW uses technical and organizational security measures to protect the stored personal data against accidental or intentional manipulation, loss or destruction and against access by unauthorized persons. Our security measures are continuously improved in line with technical progress.
